Terms of Service

1. About the operator

PulseROI is an individual sole-operator service run by Aditya Kumar Ekka, an individual based in Balrampur, Chhattisgarh, India. PulseROI is not currently registered as a company, LLP, or partnership firm. All commercial contracts are entered into with Aditya Kumar Ekka in individual capacity.

Disclosure regarding operator age: PulseROI is operated by Aditya Kumar Ekka (born 15 October 2009). He is currently 16 years old and classified as a minor under Indian law. Operations are conducted with the full awareness and consent of his legal guardians. All commercial contracts entered into by PulseROI will be countersigned or ratified by a legal guardian upon written request from any counterparty. This disclosure does not affect the enforceability of these Terms against adult users, who remain fully bound by the terms they accept.

2. Acceptance of terms

By creating an account, accessing, or using PulseROI (the "Service"), you agree to be legally bound by these Terms of Service, our Privacy Policy, and our Refund Policy. If you do not agree, you must not use the Service.

These Terms constitute a binding legal contract under the Indian Contract Act, 1872. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

3. Eligibility and age

You must be 18 years of age or older to use PulseROI. By creating an account, you represent and warrant that you are at least 18 years old and legally capable of entering into a binding contract under Section 11 of the Indian Contract Act, 1872.

I do not knowingly permit minors under 18 to use the Service. If I discover that a user is under 18, I will suspend and delete their account.

4. Your account

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorised access at pulseroi.officials@gmail.com.
• One person or organisation per account. Sharing accounts is prohibited except where explicitly enabled by team seats in the Agency plan.
• You must provide accurate, current information during signup and keep it updated.
• We reserve the right to suspend or terminate accounts that violate these Terms.

5. Description of service

PulseROI provides an AI-powered platform for researching, analysing, and comparing YouTube creators for brand marketing and sponsorship decisions. Features include but are not limited to:

• AI-generated creator analysis reports with HIRE/MAYBE/SKIP recommendations
• Fake engagement detection heuristics
• Language and regional content detection
• Creator comparison and shortlisting tools
• PulseChat conversational AI assistant
• ROI calculator and sponsorship rate estimation
• PDF report exports

I may add, modify, or discontinue features at my discretion with reasonable notice. Active paying subscribers will be notified via email at least 15 days before any material change affecting their plan.

6. Plans and pricing

Current plans and pricing are listed on our Pricing page. We offer:

• Subscription plans (Starter, Pro, Agency, Enterprise) billed monthly or annually
• One-time credit packs (Try Pack, Growth Pack, Campaign Pack)
• A 14-day free trial on the Starter plan (no credit card required)

Prices are displayed in INR (inclusive of applicable taxes where indicated) and USD. Indian users are billed in INR; international users in USD. Prices may change with 30 days' notice; existing subscribers keep their current rate until their next renewal.

7. Payment terms

• Payments for Indian users are processed via UPI and Razorpay (upon activation of payment gateway).
• GST-compliant invoices will be provided for Indian customers who provide a valid GSTIN.
• Subscriptions auto-renew unless cancelled before the renewal date.
• Failed payments may result in service suspension after a 7-day grace period.
• All payment records are retained for 7 years as required by the Income Tax Act, 1961 and CGST Act, 2017.
• The operator is currently in the process of setting up business payment infrastructure. During interim periods, payments may be collected via alternative methods documented at checkout, with full invoice and refund rights preserved.

8. Refunds and cancellation

Refunds are governed by our separate Refund Policy, which forms part of these Terms. In summary:

• 14-day money-back guarantee on subscription plans
• Credit packs are refundable within defined windows if unused
• Cancellation stops future billing but does not automatically refund current period

9. AI-generated content disclaimer

Reports, analyses, chat responses, and recommendations produced by PulseROI are generated by artificial intelligence models based on publicly available YouTube data. They are estimates and opinions, not guarantees of outcomes.

• HIRE/MAYBE/SKIP verdicts are algorithmic recommendations, not professional advice.
• ROI forecasts and sponsorship rate estimates are based on industry benchmarks and may vary significantly from actual results.
• Fake engagement detection is heuristic-based and may produce false positives or false negatives.
• You are solely responsible for verifying information and making your own business decisions.
• PulseROI is not responsible for financial losses, missed opportunities, or business outcomes arising from decisions based on our reports.

You agree that AI-generated content is used at your own risk and independent judgment.

10. Acceptable use

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any law
• Scrape, crawl, or extract data via automated means beyond intended use
• Resell or redistribute reports or platform access without written permission
• Reverse engineer, decompile, or attempt to derive source code
• Upload malicious code, viruses, or attempt to breach security
• Impersonate any person or misrepresent your identity
• Use the Service to harass, defame, or harm others
• Abuse the free trial (creating multiple accounts to extend trial access)
• Use the platform to target minors or produce content violating YouTube's Terms of Service
• Circumvent plan limits, rate limits, or paywalls

Violation of these terms may result in immediate account termination without refund and may be reported to law enforcement under IT Act 2000 Section 43 (unauthorized access).

11. Intellectual property

• Our IP: The PulseROI platform, brand, code, design, and content are owned by Aditya Kumar Ekka and protected under the Copyright Act, 1957 and the Trade Marks Act, 1999.
• Your data: You retain ownership of data you input (brand profiles, saved lists, etc.). You grant us a limited license to process this data to provide the Service.
• Reports: Reports generated for you are yours to use for your business purposes. You may not resell them or claim them as your original work without disclosure.
• YouTube data: YouTube data displayed via our platform is public data fetched via YouTube Data API and remains subject to YouTube's Terms of Service and Google's policies.

12. Termination

We may suspend or terminate your account without prior notice if:

• You violate these Terms or the Acceptable Use policy
• Your payment fails and remains unpaid after the grace period
• Required by law or court order
• You engage in fraud, abuse, or activities harmful to the Service or other users

You may terminate your account at any time by emailing pulseroi.officials@gmail.com. Termination does not entitle you to a refund except as expressly provided in the Refund Policy.

On termination, your right to access the Service ceases immediately. Your data is deleted per the retention schedule in the Privacy Policy.

13. Disclaimers and warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

To the maximum extent permitted by applicable law, we disclaim all warranties including but not limited to:

• Merchantability and fitness for a particular purpose
• Uninterrupted, secure, or error-free operation
• Accuracy, completeness, or reliability of AI-generated content
• Availability of third-party services (YouTube API, AI providers, payment gateways)

14. Limitation of liability

To the maximum extent permitted by Indian law:

• Our total aggregate liability for any claims arising out of or related to the Service shall not exceed the total amount you paid to us in the 12 months preceding the claim, or ₹5,000, whichever is greater.
• We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities.
• Nothing in these Terms limits liability for gross negligence, fraud, or matters that cannot be limited under Indian law (Consumer Protection Act 2019 protections remain intact for consumers).

15. Indemnity

You agree to indemnify and hold harmless Aditya Kumar Ekka and PulseROI from any claims, damages, or losses arising from:

• Your violation of these Terms
• Your misuse of the Service
• Your violation of any third-party rights (including YouTube's ToS)
• Business decisions you make based on AI-generated reports

17. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of India, including but not limited to:

• Indian Contract Act, 1872
• Information Technology Act, 2000
• Digital Personal Data Protection Act, 2023
• Consumer Protection Act, 2019
• Copyright Act, 1957
• CGST Act, 2017 (where applicable)

Exclusive jurisdiction for all disputes lies with the courts at Balrampur, Chhattisgarh, India. Consumers retain the right to approach appropriate consumer forums under the Consumer Protection Act, 2019.

Before initiating legal action, parties agree to attempt good-faith resolution via the Grievance Officer within a 30-day period.

18. Copyright complaints & takedown

PulseROI respects intellectual property rights under the Indian Copyright Act, 1957 and international copyright norms (including DMCA principles). If you believe that any content generated, indexed, or published on PulseROI infringes your copyright, please notify our designated agent with:

• Identification of the copyrighted work claimed to have been infringed.
• Identification of the material that is claimed to be infringing and its URL or location.
• Your contact information (name, address, telephone number, email).
• A statement of good faith belief that use of the material is not authorized by the copyright owner, agent, or law.
• A statement made under penalty of perjury that the information provided is accurate and that you are authorized to act on behalf of the owner.

Send all copyright infringement notices directly to: pulseroi.officials@gmail.com (Subject: "Copyright Takedown Notice"). Valid notices are acted upon within 36 business hours.

19. Trademarks & comparative claims

YouTube, Google, Instagram, TikTok, Twitter/X, Modash, and HypeAuditor are registered trademarks of their respective owners. Their mention on PulseROI is strictly for descriptive, identification, and fair comparative analysis purposes under Section 30 of the Trade Marks Act, 1999. PulseROI is not affiliated with, endorsed by, or sponsored by any of these third-party entities.

20. Changes to terms

We may update these Terms from time to time. Material changes will be notified via email at least 15 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
